Under Donald Trump‘s administration, every day, there is a new controversy. Mostly because no one is sure how the government is running and what policies are in place.
When the deportation process started for illegal immigrants, it was said to only deport people with criminal backgrounds. However, it then started including innocent people, old people, and kids from elementary schools. Now, ICE is picking up people from their immigration hearings. There is no rule of law or clear indications as to where it will all go and when it will end.
Everyone in the country and administration is worried about immigration status and what it means for the several legal immigrants, too.
A recent House Judiciary Committee meeting was one such stage where questions about immigration policies were being asked. Democratic Representative Jasmine Crockett asked questions about First Lady Melania Trump‘s immigration status. This reignited controversy over the fairness and transparency of the US visa system.
During the hearing, Rep. Jasmine Crockett criticized the Trump administration’s immigration policies. She especially talked about the practice of revoking visas based on people’s social media posts. She claimed that such regulations violate the constitutional right to free speech and also unfairly target immigrants for expressing political beliefs.

“This country cannot uphold democratic values while punishing people for what they say online,” according to Crockett. “We must ask: is this about national security or silencing dissent?”
Her comments also brought attention to broader issues. It included selective enforcement and the use of immigration law for political purposes.
Crockett then focused on Melania Trump’s EB1 visa status. This is also known as the “Einstein visa.” It is normally given to people who have achieved extraordinary heights in their careers. These include Nobel Prize winners, renowned scientists, and Olympic athletes.
The congresswoman then questioned whether Melania’s qualifications fit the visa’s stringent requirements. “Where are the international awards, the groundbreaking work, the peer-reviewed accomplishments?” she roared.
Crockett: Melania, the First Lady, a model— when I say model I’m not talking about Tyra Banks, Cindy Crawford, or Naomi Campbell level— applied for an Einstein visa. You’re supposed to have some sort of significant achievement… She had none of those. It doesn’t take an Einstein… pic.twitter.com/u0c1SXJE8I

Crockett then used Melania Trump’s modeling history. She included a nude photo shoot for GQ magazine to back up her point. She claimed that such work does not meet the level of differentiation typically required for EB1 classification.
“This is not about moral judgment,” Crockett explained. “It is about ensuring that our immigration system is implemented fairly and consistently, without being affected by fame, riches, or proximity to power.”
Alex Nowrasteh, who is a spokesman of the libertarian Cato Institute, presented a tongue-in-cheek defense of Melania Trump’s EB-1 visa. “If marrying Donald Trump doesn’t count as an extraordinary achievement, I don’t know what does,” he said, which elicited laughter from the chamber.
A witness’ joke about Melania Trump cracked up Rep. Jasmine Crockett, who questioned why the First Lady was granted an Einstein visa. “I want to defend Melania … not everybody could marry Donald Trump and I think that’s quite an achievement,” Cato Institute’s Alex Nowrasteh… pic.twitter.com/GG6dG9O6NI

However, Crockett was quick to answer. She said that marrying Trump may be an unusual path, but that doesn’t mean it is a legitimate qualification under immigration law. Also, Nowrasteh’s comment had hints of misogyny, and it was more disrespectful towards the First Lady than Rep. Crockett asking about her visa process.
Their conversation highlighted the conflict between celebrity privilege and the immigration system’s purpose.
As the fight over immigration enforcement and elite privilege continues, Rep. Crockett’s comments have reignited questions about justice, transparency, and who genuinely qualifies for America’s most prized visa programs.
